1. Acceptance of Terms

By downloading, installing, or using AvatarAI, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of the app immediately.

2. Service Description

AvatarAI provides AI-powered avatar generation from user-uploaded photos. You upload a photo, select a style, and our AI service generates a stylized avatar based on your selections. Results may vary based on photo quality, style selection, and AI processing.

3. User Content & Photo Processing

You retain full ownership of the photos you upload. By uploading a photo, you grant us a temporary, limited license to transmit and process the photo through Black Forest Labs (a third-party AI service) solely for the purpose of generating your requested avatar.

You represent and warrant that:

• You own the photos you upload, or have obtained consent from the person depicted
• You will not upload photos of minors without parental consent
• You will not upload photos of others without their explicit permission

4. Generated Content

You own the avatars generated from your photos and may use them for personal or commercial purposes. We do not claim ownership of generated avatars. However, you acknowledge that AI-generated content may occasionally produce unexpected results.

5. Credits & Purchases

• Credits are purchased via in-app purchases through Apple
• Each avatar generation consumes credits as displayed before confirmation
• Credits are non-transferable
• Refunds are handled according to Apple's refund policies
• We reserve the right to modify credit pricing with reasonable notice

6. Prohibited Use

You may not use AvatarAI to:

• Generate deceptive, fraudulent, or misleading content (e.g., deepfakes for impersonation)
• Create content that is illegal, harmful, threatening, or harassing
• Generate explicit, violent, or otherwise objectionable content
• Violate any applicable laws or regulations
• Infringe upon the rights of any third party

We reserve the right to terminate access for violations without refund.

7. Limitation of Liability

AvatarAI is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.

8. Modifications

We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the updated terms.

9. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
